The federal appeals court has upheld a ban on deploying national guard in Portland, Oregon, after a recent legal decision.

Judicial Panel Agrees to Rehear Legal Matter

The ninth circuit court of appeals decided on this week that it would rehear the legal dispute concerning the president’s authority with an expanded group of 11 judges. The court also overturned a previous decision from a smaller judicial group that had supported the administration.

Legal Saga Over Troop Deployment

This order represents the latest turn in a protracted court case over whether the former president has the legal right and justification to send state military units in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the deployment effort was initiated in response to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that government employees at the immigration center in south Portland were under attack, while city and state officials maintain that local officers have command of the situation.

Contrary to descriptions of Portland as a conflict zone, residents have been sharing videos of lush hiking trails and a thriving food scene, and organizing activities such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two temporary restraining orders this month – one blocking the federalization of the Oregon national guard, and another stopping the use of any military personnel in the state, after efforts to circumvent the first order by calling up out-of-state forces.

On Monday, the appeals court had put the first ruling on hold – permitting control of state troops – but the subsequent injunction stayed effective, preventing the physical sending of the forces.

The latest ruling means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a group of eleven justices.

“This ruling shows that facts are important and that the judicial system are striving to ensure government responsibility. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot dispatch the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, principles, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
